Estates and Trusts,Planning and LitigationWe provide sophistocated tax and estate planning for clients facing a significant estate tax burden. We utilize a variety of trusts drafted for each specific situation, and may utilize California law, Delaware law, or the law of some other state or foreign jurisdiction. Many of our plans include charitable giving and establishing private foundations. We also provide international tax planning if needed. After the death of a family member, we assist with estate and trust administration, and completion of the federal and state estate tax returns (including the federal generation-skipping transfer taxes). Where a family living trust is involved, sub-trusts usually are created upon the death of a settlor/trustor, and we work with the family accountant to ensure the funding, accounting, and income tax reporting for these trusts are properly accomplished. Where insufficient planning has occurred prior to the death, we work to develop tax-savings strategies to reduce the tax burden (if possible), or other techniques to accomplish family goals. The real job of the lawyer is to preserve both the assets and family relationships. Our estate and trust work is coordinated closely with the goals of family succession planning and asset protection so that family and business objectives are met -- at the same time as tax-savings and estate objectives. Even with the best of planning, sometimes disputes must be brought before the courts for resolution, and our litigation attorneys handle only trust, estate, and tax matters. We also represent beneficiaries and trustees in advising and protecting their interests in trusts and estates which are not administered by us. We also provide mediation services to families and counsel seeking to resolve estate, trust, and tax matters without litigation.
